im not divorced yet but left the marital home.do i have a legal right to return to the home?

Yes you could move back in. DO NOT MOVE BACK IN UNTIL YOU TALK TO A DIVORCE ATTORNEY.

This gets messy and even dangerous for you. YOU risk a lot of problems if you do not get some advice, up to and including charges of domestic violence (even if you do not do anything wrong, you may still be accused) and a lot of other ugly problems.
