Legal Question in Family Law in New Jersey

This really has to do with a girlfriend, promise. She has quite a bit of money. She's been engaged to a man in real estate for over 5 years. He has explained that the reason they have not married is for her protection; i.e, if he were to get sued the and the person won, they could be awarded monies out of her estate. The question is: If they were to have prenuptial agreements, could what he has told her still occur?

This is not...well, she really needs to either have him talk to a lawyer to get a better understanding of his exposure and ways to manage that risk, or she needs to get a clearer idea of her risk. If she marries him and does not have anything to do with his business, she is not liable for debts owed by her husband for failed real estate.

This is one of the very reasons we encourage prenuptial agreements - to protect assets in the event of such a problem.

He needs to speak with a lawyer if he is concerned and she needs to determine if what he is saying is his misunderstanding or an excuse.
