Legal Question in Family Law in New Jersey

guardianship of an incompetent parent

dad is unable to care for himself and wont sign a power of atty. allowing mom and the kids to put him in a home. mom is unable to care for him anymore as she is disabled as well. if we get a note from a m.d. that dads incompetent does a lawyer apply to court or do we just go to the surrogate?
