Legal Question in Family Law in New Jersey

non-parental child custody

My brother and his g/f just delivered a baby thurs. The baby was born addicted to drugs and DYFS is involved. She is being held at the hosp. until my brother takes his drug test. As soon as his g/f was let out of the hosp. she went right back to the house she was doing drugs at. We know she will not stop. She is adopted and talking about letting her aunt take care of the baby during the day and me have her at night. The aunt's house is not a place the baby should be raised. Neither of them can take care of this child. She has no job,HS drop out and they are homeless. My queston is what are the chances of me and/or my mother-the babys biological family-trying to gain custody of the baby so that she will have a stable and loving home to be in.

Re: non-parental child custody

If DYFS is involved you are going to have to work with them. They should remove the child from the house and place the child somewhere else. I can try to put you in touch with the right people at DYFS if you want.

Otherwise, you are going to have to handle this through the courts.
