Tenant Updates to Property

Tenants who rented a mobile home for approximately 3 years made many changes to the mobile home. A deck was added and they installed central air. The tenants habitally paid late and we discovered they had abandoned the property recently. They left behind some personal belongings inside the trailer, a lot of trash and dirt, and quite a bit of damage. The mobile home park evicted them due to non-payment of the lot fee. My question is--can they remove the deck and/or central air conditioner? There is no rental agreement only a verbal agreement; however, they never sought permission to make these upgrades.

The deck and air conditioner, provided it is a central air system and not a window unit, are considered "fixtures." his means they are now apart of the property. If you wantto remove them , as the property owner you can do so. You might want to check with the local building dept. to insure you do not need a permit for the renovations.

An arugument can be made that the deck and A/C unit became fixtures to the property and cannot be removed by the tenants.
