My sisiters and I plan to contest our father's will. We believe he was coerced into changing his will two months before his death, leaving everything to our half sister. What type of lawyer should we contact?

You should retain a lawyer that is experienced in probate litigation and particularly, will contests. I have represented clients in will contest cases, so if the probate is in Arizona, I am able to represent you. Remember, you have the burden to prove that your father was incapacitated, or under the control or undue influence of your 1/2 sister, or that he thought he was signing something else than a new will.

Your question heading indicates Ohio law is involved. Toledo is fortunate to have a highly qualified firm that specializes and engages in probate litigation throughout the state. The firm is Kolb & Zigray, 405 Madison Ave., Suite 2000, Toledo, Ohio 43604.1227; 419.244.3006. I have referred several matters and clients to them and have always been pleased.

Where did your father live when he passed, and has his will be submitted to probate? A will contest needs to be filed in the county and state where he resided when he passed away. Is there any evidence that he was incompetent or susceptible to undue influence when the will was changed? You need an attorney experienced in both litigation and probate. In Ohio, there is a three month statute of limitations on a will contest, so time is of the essence. You must act now.
