Calculation of pension benefits.

I was hired on 4/78 as a "floater.I was paid by the company that hired me.I worked a 40hr week but was afforded no benefits. A "floater" worked at various jobs within the company and was paid by the company. I was officially hired as a permanant employee on 2/82. I wish to take early retirement. The company does not want to include the years between 4/78 and

2/82 in the pension calculation. I want to know if i have a legal basis to have those years included in the calculation.

Your right to have your early years of service included in your pension calculation will be determined by the language of the company's pension plan. You have a right under ERISA to see the pension plan which should define years of service.
