Legal Question in Employment Law in Pennsylvania

Pregeant and laid-off

I was employed for a company for a year and a half. I recently became pregnant and it seemed as soon as my boss found out, I was laid off..the reason being he did not need a full-time switchboard operator. I beleive it was because I was pregnant. Now I just found out that a college girl was hired in my place for the summer. Shouldn't I have been called back to work the summer months, instead of hiring someone else..I feel that I was discriminated against. Is there any thing I could do??

You should immediately go to the EEOC or state Human Relations Commission. Pregnancy discrimination is prohibited. Tell the Commission your story and let them investigate. You may want an attorney to start on the case right away. If you need more information email or call.

Re: Pregeant and laid-off

If the true reason you were laid off was because your company didn't need a full-time operator then you probably can't do anything about it. But, if the fact that you were pregnant influenced the decision at all to fire you then you might have a suit for pregnancy discrimination. The mere fact that both of the incidents appear to happen at nearly the same time suggests that the fact that you were pregnant may have played a part in your termination decision. In PA you only have 180 days from the time of the discrimination to file a complaint with the Pennsylvania Human Relations Commission or the EEOC or you will lose your right to recover.

The laws on discrimination are tricky and you need to talk with an attorney who, after hearing all the relevant evidence, can make a determination whether or not you might have a case.
