Re: Weingardner rights

You asked about Weingarten rights.

This refers to the name of a case that provides that an employee has the right to have an impartial witness or representation whenever during an interview by an employer that may have an adverse impact.

In other words, if the boss calls and says we need to talk about the widgets that have disappeared from your workspace, you have the right to either have an attorney present or ANY employee (of your choice) present as a witness. The lawyer or witness has no right to say anything during the meeting but is there to act solely as a witness or advisor.

An employer cannot refuse to allow an employee to exercise their Weingarten Rights or take any retaliatory action if an employee exercises those rights.

Regards,

Roger
