This is a tough area because everyone goes through it but there is rarely enough money involved to interest most attorneys. Your best bet is to come to some type of agreement, usually landlord keeps the % of the money of the unrented time of the unit (actual or within reason) and the tenant gets back the rest.

Some landlords are a-holes and get a power trip from messing with tenants.

Make it clear to your landlord that you are unafraid of litigation.

Make sure the landlord has the money in an escrow account and notify account holder that it is in dispute status so that one may not touch the money until the dispute is settled.

What you really want is a fair compromise so that you can just move on. Sometimes a little bit of money is not worth the bitter taste.
