Legal Question in Family Law in South Carolina

My ex-husband has primary custody of our three children under 10. I do not pay child support, but I did agree to pay a certain amount of unreimbursed medical expenses. He is trying to say I owe him half of his cost for over-the-counter medications and things like band-aids. Is that correct?

Generally the order will say that each parent will be responsible for a certain percentage of uncovered medical/dental expenses. The answer to your question is no, unless your order specifically states that you must pay a percentage of all over the counter products. If your order is the normal language without specifically naming over the counter items then you should not be responsible for those items. The language generally states "uncovered" medical expenses---which means the portion that the insurance has not paid. Usually this means any co-pays, deductibles and/or the portion that the insurance requires the insured to pay (if insurance covers 80% then the leftover 20%).
