Legal Question in Workers Comp in South Carolina

Their Fault

I got injured a while back inside of a dam. A broken femur, ripped open calf muscle, and a broken index finger occured when a grinding rock spun off of the threads of a grinder in which had no safety guard. In fact, none of the grinders at the job site had safety guards. The company makes more profit the faster the job gets done therefore they overlook safety quite a bit. This time it caused my accident. Can I sue this company for anything? They laid me off 10 months ago and are picking back up, but are avoiding my phone calls. I don't think they have any intensions of putting me back to work. By the way, they are a VERY wealthy copmany!

Re: Their Fault

I assume this is a SC company and the accident occured in SC. There are issues related to whether you can sue the company. You might be restricted to a Workers Comp. claim against the company. However, you might have a Products Liability claim against the manufacturer of that equipment. How many companies where involved in this operation? Who exactly owns the machine? Who services the machine? My firm is in Myrtle Beach and I handle negiligence claims state-wide. You can click on my name for my office number or email at [email protected]
