Conservatorship is an issue which deals with the best interest of the child. The factors you mention are important, but not enough, alone. Your attorney will discuss the various ways to establish that this child is better living primarily with you. The debts are marital ones, unless the court makes a finding that you were defrauded, and could possibly award all of the debts to her. If she doesn't pay them, however, the creditors will still come looking to you for payment; again unless have proof that rises to a legal level of fraud. Your attorney will be able to help you.

Texas does not have legal separations; but does provide that once the divorce is filed, a temporary hearing can resolve some of the differences while awaiting final hearing.
