Legal Question in Criminal Law in Virginia
trespass
I have an unwanted house guest who refuses to leave my home. How do I get rid of him. I am leasing part of the house from the owner who also lives on the property and refused to make this person leave.

If the unwanted(from your perspective) house guest
is occupying that part of the property where the owner is residing(and apparently tolerating his continued presence), and which is not covered by your lease, you would have no authority to make this person leave from that area of the property. That, of course, would not apply if in fact this person was intruding into your leased space, and, if so, you could file an unlawful detainer action in the general district court to have him evicted.
