Legal Question in Employment Law in Virginia

severance guidance

Hi,

A friend was just laid off from a civil engineering company in VA. She's been employed for over 1 year. Slow business is the expected reason. They've given her 2 weeks pay. Can she ask for more? What options does she have?

Re: severance guidance

She can ask for whatever she wants, but it is generally a negotiation issue -- unless she has a contract she is probably an employee-at-will and can be terminated for any reason or for no reason without any serverance.

The big issue is what they want her to sign when she takes the severance. Typically, they are going to want a whole bunch of releases. She may want to have an attorney make sure that at least she knows what she is releasing and giving up before she signs things.
