Legal Question in Wills and Trusts in Wyoming

No assests other than house

I was my mother's guardian and conservator. I am an only child. She died May 1.

Her only asset is her home which is mortgaged for about what it is worth. She had many outstanding debts (credit cards etc). The state will put a lien on the house for the Medicade she recieved. So the estate is several thousand dollars in the red. Is there any reason to go through probate? Can I just let the mortgage holder have the house and notify her creditors that she died?

Re: No assests other than house

If you are sure the estate is insolvent, then you need do nothing more than you suggest. If a creditor thinks an estate is necessary, then he can institute it. Unless you signed to do otherwise, you are not legally responsible for your mother's debts.

You have our condolences for your loss.
