Legal Question in Family Law in Minnesota

Can a parent move a child to a different state?

I have a friend who would like to be divorced, but he is concerned that his wife could move their child to another state. Is this possible?

Re: Can a parent move a child to a different state?

It is certainly possible that may occur before the divorce is filed. There is nothing to prevent it up to that time.

Once a divorce is filed, neither party may move the child out of state and there will be a presumption that the child should remain in the child's home state. It does not preclude either party from ultimately seeking custoody and relocating out of state. However, that is not always so easy to do if both parents are reasonably fit for the task of parenting.
