Second medical opinion for injury

How do I go about requesting a second opinion for the diagnosis and treatment of a work related injury? I tried to see an independent doctor, but my insurance will not cover it because it's the responsibility of Workman's Compensation to treat the problem.

You are in a catch 22. If I represented you in your case I would pay for an independent medical examination. I would use that IME to try and advance the case forward (i.e. settlement, more medical treatement, etc.). If you want to discuss this further please give me a call.

If you are being represented by an attorney, you should direct all of your questions concerning your claim to that attorney. If you do not have an attorney, you should. The employer's insurance carrier is duty-bound to close your claim as cheaply as possible. They are not concerned with doing what is best for you. An attorney will make sure that your rights are protected and will do everything possible to be sure that you receive fair compensation under the law for your injury. Your attorney may be able to persuade opposing counsel to obtain authority to pay for you to be seen by a doctor of your own choosing. Or, in some cases, your attorney might need to get a court order from the worker's compensation administrative law judge. In many cases, your attorney will have a number of doctors who work with that attorney who will examine you and provide that second opinion in addition to a "rating" for worker's compensation purposes. These doctors may also agree to wait for payment until the claim is settled or otherwise finalized.
