I run a tutoring service. A student paid a year's tuition fee and then cancelled attending in the time allowed. I mistakenly credited the student's account twice. Legally, does the student need to repay the second credit even though it was my mistake?

YES, you have every right to your own money... even though it was paid out in error. Generally, the best and most cst effective way to go about this is to have an attorney draft a letter for you threatening possible litigation if this money is not paid in return, generally this is enough - if not then you will have to take the case a step further and actually file a lawsuit against the student.

Yes, of course they do. There are a number of legal theories which permit recovery of your money in this circumstance, but I'm confident that a well-written demand letter from an attorney would achieve the same result far more quickly.
