Legal Question in Criminal Law in Virginia

Capeus on a capeus

I missed a court date on April 3, 2006 to get an assault and battery removed from my record after 2 years of probation and domestic violence counseling. My 2nd court date was on July 3rd. I went to work and missed the court date due to the holiday falling on a Monday and me choosing to go to work instead of taking the day off. My question is, should I hire counsel or hope the judge will side with me since I've completed all requirements and was getting my charge removed from my record.

Re: Capeus on a capeus

I'm assuming when you missed your Court dates, the Court issued a capias for your arrest and charged you with Failure to Appear. If you have two of them outstanding and still must appear before the Judge to get the A&B dismissed, you have some explaining to do and local attorneys always do that better with local judges. You didn't need an attorney to show that you suceeded your program but you need one now to stay out of jail on the Capias and making sure the Judge isnt soured by your non-appearance not to dismiis the A&B.

Hire a good lawyer.

Good luck
