Legal Question in Civil Litigation in Colorado

I own a 2006 Jeep Wrangler for my ex-boyfriend. I do not drive this vehicle. I have never even been in this vehicle. It is HIS vehicle. I am the sole owner and he is making monthly payments. Because I am unable to financially afford making payments, we wrote out an agreement and it was signed by both him and myself.

The agreement states: "I, (ex-boyfriend), am solely responsible for all payments, insurance, maintenance and all other responsibilities that arise with the 2006 Jeep Wrangler owned by (me) in August of 2009 until refinancing. I, (ex-boyfriend), am liable for the entirety of this vehicle and agree to aid in refinancing as soon as possible." This agreement is signed by the two parties.

He has been threatening to drop off the Jeep when he knows I am unable to make the payments. Because of this agreement, do I have a leg to stand on if this situation pans out to the Jeep being left at my doorstep?

Also, I have perfect credit (which is why I had to be sole owner of this vehicle). I was notified yesterday that he has unpaid highway toll violations amounting to nearly $650.00. I did break down and pay one violaion for $47.25 because I was constantly called by a debt collector. Is there a way to make him pay these violations without me having to? And can I get him to pay me the $47.24? I know, I made a huge mistake being young and naive, but I have to deal with my mistake and figure out where to go from here.

I am just so lost about what to do. I really do need help.

Sorry for the problems. You could consider filing suit for the amounts due in small claims (assuming the amount is below the small claims limit). Unfortunately, while this may be good if you can win a judgment, the actual collection of that judgment is another issue. Moreover, as for the damage to your credit, that will take much more work by contacting the agencies and collectors directly and they can be, to the say the least, difficult.

Ultimately, this is going to be difficult and time-consuming. Here is the small claims website with forms and information http://www.courts.state.co.us/Forms/Forms_List.cfm/Form_Type_ID/9.

I wish you the best. Good luck.
