Legal Question in Civil Litigation in Florida

Neighbor Problems

My new neighbor (4 years) keeps cutting the main roots to my plants/flame vines on my fence, along our mutual property line, which he has admitted to doing. I have confronted him three times about this. I have very manicured landscaping -- he does not. I have lived here since 1960 and have never had any problems with neighbors. What can I do?

Re: Neighbor Problems

When you say "confronted" do you mean you politely told him to leave your vines alone OR did you show him exactly where the main roots are, determine how he keeps cutting them (is his dog chewing them, is it his weed eater?), determine if it is an accident or on purpose, and did he say he was sorry?

On the property line, it's probably not trespassing, but if it's your personal property which he is harming, you could send him a bill for the value of a dead plant. Probably not the best way to break-in a new neighbor, though. I suggest being assertive, but nice, and try to determine the root of the problem and why it keeps happening. Chances are very good that he is not doing this on purpose, and he will work with you to keep this from accidentally happening again.

Best of luck!!
