Legal Question in Employment Law in Illinois

Unfair discharge of employment

I was employed fulltime at another hospital when I was offered another fulltime position with another company. I went parttime at the previous employer and started fulltime with new company. Into the third week, and three days after officially going parttime at other employer, was called into office and told they needed to "reduce workforce." They gave me 2 days severence pay. I was unable to go back to fulltime at previous employer due to their own contract negotiations. Therefore, it has taken me a month and a half to find other fulltime employment. My family's financial situation is largely dependent on my income and we are in dire straights due to this unforseen discharge. I know about "free will" employment, however, I feel further compensation is warranted. Would I be able to take them to small claims court?

Re: Unfair discharge of employment

Hello and thank you for your

question. In my opinion,

you will not be able to file

a successful suit against

your employer in Small Claims

Court. Assuming the employer

in question has paid you in

full for the work that you

have done, under the law, you

would be entitled to no more

than that.
