Child Visitation

My son may be going to jail for 6 months soon. He has visitation rights to his 2 year old daughter. While he is in jail, can his visitation rights be transferred to me, his mother and how will it affect his child support payments?

Re: Child Visitation

You can visit your grandchild as much as the mother will allow you. If she will not, you can ask the court to grant you particular visitation privileges with your grandchild if it is in the child's best interest. Your son's child support obligation is not affected by his being jailed. Since he is the cause of his temporary interruption of income, he cannot use that interruption as an excuse to have his obligation lessened or suspended.
