Sibling Rights

1. Can a sibling be removed or award reduced from a medical malpractice lawsuit by the mother of the deceased or anyone else, where the death of the sibling occured? The lawsuit is in the court system at this time the mother has threatened to remove the sister of deceased from the lawsuit for personal reasons.

2. Can the other members of the lawsuit put restrictions or the amount received by the sister of the deceased. Do all siblings get the same amount in a wrongful death medical malpractice lawsuit?

The mother as the representative for the case, has the obligation to notify all close relatives in the event of a recovery. A hearing will be held before the judge to determine how the proceeds of the case (if recovery is successful) will be distributed. Each person come come in alone or with their attorney.
