Legal Question in Credit and Debt Law in Ohio

responsibility for spouse's debt

I have been married to my husband for less that 3 years. I owned a house before I married him. I didn't know that he had $40,000 in credit card debt that he was making minimum payments on. Now, he is terminally ill and has defaulted on balances of $50,000. Am I responsible for his debt? Can a creditor legally obtain a judgement for a lien on my house?

Re: responsibility for spouse's debt

No, you are not responsible for his debt, but if the creditors get a judgment against him, it can act as a lien on the 1/3rd curtsy interest he has on your property which he got when he married you. He should look into filing bankruptcy ASAP.
