Legal Question in Workers Comp in South Carolina

shoulder injury

My husband hurt his shoulder at work to the extent of now needing surgery, which will be January 21. It appears the Employer lost his paper work that was filed when the injury occurred a couple of years ago. Their Insurance Company has paid a bill recently. Today we recieved a letter from workers compensation stating they received a notice from the carrier/employer that denies he sustained an injury that qualifies him for Worker's Compensation. Is there anything that can be done? Will we be fighting a losing battle. My husband cannot find his copy of the report. Thanks.

It sounds like they already accepted liability. It doesn't make sense that two years into it, and after paying a medical bill, they would turn around and deny the claim. You asked what can be done. Your husband has every right in the world to contect it. I am very curious if they have been paying him any money while he has been out of work? As far as lost paperwork, that can be obtained.
