Legal Question in Civil Litigation in Indiana

Over a year ago my rare toy poodle of 11 years old (4LBS) was stolen by a children who thought he was a puppy. After investigating I found out which children stole him but could not find the people. I made a police report, placed a missing ad on PETFINDERS and put award posters all over the area. Now a year later I find an ad on PETFINDERS where an AGENCY(POODLE RESCUE) has him up for ADOPTION!! When I called to inform them that this was my stolen dog, the lady became very rude, hanging up the phone, blocking my number and refusing to return my dog! I have proof that he is mine, vet bills, hospital bill when he was injured, his shot records and all. I want my "child" back! He will grieve for his rightful family. If he is adopted to another family I am afraid I will never see him again! Please Help! What CAN I DO TO GET MY DOG FROM THE POODLE RESCUE AGENCY?

First, write a letter to them. Tell the story, much like you have here. Make sure you detail the conversation you had with them, including the rudeness. Send it certified. Keep a copy. Tell them in the letter that if they do not return your dog, you will file suit to get him back. Enclose a copy of a police report.

If no response very soon, file a suit in Small Claims Court, as already suggested. Include the allegation, in your suit, of conversion. (Honest, it isn't a religious term.)

You can do the case yourself, or you can hire a lawyer. Not sure you'd get your attorney fees back from them in such a case. Depends on a few things.
